Bay Mills: Will the Supreme Court Limit Tribal Sovreign Immunity?

The-Federalist-SocietyMr. Graydon “Dean” Luthey, who leads the gaming and Indian law practice at GableGotwals, will discuss the pending Supreme Court case: Michigan v. Bay Mills Indian Community during the Federalist Society meeting On April 21. The Supreme Court granted certiorari in Bay Mills to address two issues: (1) Whether a federal court has jurisdiction to enjoin activity that violates the Indian Gaming Regulatory Act but takes place outside of Indian lands; and (2) whether tribal sovereign immunity bars a state from suing in federal court to enjoin a tribe from violating IGRA outside of Indian lands.
