Timothy A. Carney has over 25 years of legal experience representing a variety of clients in many types of disputes. Tim’s expertise includes representing insurance companies in insurance-related litigation and disputes, counseling employers on a day-to-day basis concerning employment issues, defending employers in employment discrimination litigation and disputes, and representing businesses and individuals in commercial disputes. Tim has represented clients in both complex cases and class actions. His specific practice areas include labor and employment litigation, insurance and ERISA litigation, business and commercial litigation, and arbitration and alternative dispute resolution.

Tim graduated with his bachelor of science in financial management from Southwest Missouri State University in 1983. He graduated with honors from the University of Tulsa College of Law in 1986 as a member of Order of the Curule Chair. Tim was also a staff member of the Tulsa Law Journal.

Since Tim’s admission into the Oklahoma Bar Association (OBA) in 1986, he has won many honors including being named as an Oklahoma Super Lawyer and as one of The Best Lawyers in America. Tim was named Best Lawyers Insurance Lawyer of the Year in Tulsa in 2011.

Among other things, Tim:

  • Regularly represents employers, self-insured plans, insurers, and plan administrators in disputes and claims involving life, medical, health, and disability insurance or benefits, severance and pension benefits, and other benefits under ERISA, and claims for civil penalties, breaches of fiduciary duty and retaliation or discrimination under ERISA. Tim has had a number of published district and appellate court opinions in the ERISA area.
  • Regularly represents insurers in actions alleging breach of contract, fraud, “bad faith” and other torts arising from the sale of insurance policies and the handling of claims arising under insurance policies.
  • Regularly counsels employers in all aspects of employment law, including the discipline and termination of employees, medical and disability leave issues, compliance with various federal and state laws and regulations, and many other types of employment-related issues.
  • Regularly defends employers against claims for employment discrimination, retaliation, wrongful termination or other alleged unlawful employment practices under various types of federal and state laws, in single plaintiff, collective and class actions.
  • Regularly represents businesses in disputes concerning the theft of trade secrets, non-compete clauses, employment contracts, unfair competition, and other types of commercial and business disputes.

Tim is a member of the American Bar Association, Oklahoma Bar Association and Tulsa County Bar Association. Tim is also an Adjunct Settlement Judge for the United States District Court, Northern District of Oklahoma. Tim is also involved in a number of charitable and civic organizations.
