David L. Kearney

David L. Kearney has 25 years of legal experience. A University of Oklahoma graduate, David received his Bachelor of Business Administration in 1982 and his Juris Doctorate with distinction in 1985. In 1988, he authored “The Take or Pay Controversy from the Pipeline Perspective.”

David's recent experience includes:

Representation of a major oil company in a pollution action involving alleged salt-water pollution of a fresh water aquifer.  This action involved complex hydro-geological evidence and testimony.  A favorable settlement was reached prior to the return of the jury verdict.

Defense of a major insurance company in a federal action involving allegations that an insured was mentally incompetent to change the beneficiary of his policy prior to his death by suicide.  The insurance company had paid death benefits pursuant to the beneficiary change. A defense verdict was rendered in the case.

Representation of an international oil terminaling facility in Aruba in an action for breach of a tank cleaning contract involving in excess of $1 million.  This representation required investigation and depositions in Aruba, N.V., U.S. Virgin Islands, and Panama City, Panama.

Representation of an international  oil field equipment manufacturer in several products liability cases involving claims of wrongful death and serious personal injury.

Acted as the chairman of a group of major oil & gas companies who were joint defendants in a pollution case involving the disposal of high chloride drilling mud. The case required coordination of a joint defense strategy including expert witness testimony and motion practice. After substantial litigation, the case settled on favorable terms for the defendants.

Representations of several major oil & gas companies in condemnation proceedings seeking to acquire extensive right of way for pipeline installation or for underground storage space for the storage of natural gas.  These cases require the filing of multiple separate actions, the negotiation of multiple settlements and ultimately the trial of any cases wherein an acceptable settlement cannot be reached.

Representation of several life and disability insurance companies in claim disputes over the denial of coverage, fraudulent applications and the interpretation of policy terms.
